Terms and Conditions

1. General Provisions

These Terms and Conditions set out the rules for using the FitNexus website and for receiving personal training services, consultations, and appointment bookings.

2. Scope of Services

• presentation of personal training offers and programs,
• contact via email, phone, WhatsApp, and forms/links on the website,
• appointment booking via Calendly,
• delivery of training services after individual agreement on the terms.

3. Nature of Information on the Website

Information about prices, programs, and packages is provided for informational purposes and does not by itself constitute a binding offer, unless expressly stated otherwise in a separate message or offer.

Selecting a package on the website and moving to the contact page expresses interest in the service, but does not automatically conclude a contract.

4. Technical Requirements

• a device with internet access,
• an up-to-date web browser with JavaScript and cookies enabled,
• an active email address or phone number if you want to contact us,
• access to external services such as Calendly when using online booking.

5. Rules for Using the Website

• use the website lawfully and in line with good practice,
• do not submit unlawful, offensive, or third-party infringing content,
• do not attempt to disrupt the website, scan for vulnerabilities, or scrape content without permission,
• do not impersonate others or provide false information when booking or contacting us.

6. Bookings and Service Start

A meeting may be booked online or arranged directly. The detailed scope of the service, location, date, and price are confirmed individually.

If the client gives express consent for the service to start before the end of the withdrawal period and confirms that they were informed about losing the right of withdrawal once the service is fully performed, the applicable consumer-law rules will apply.

7. Prices and Payments

• prices displayed on the website are shown in PLN,
• the exact payment method is agreed individually,
• if taxes or additional fees apply, we will inform you before the contract is concluded,
• the provider may update the price list, but changes do not affect the agreed terms of a specific service.

8. Consumer Withdrawal

As a general rule, a consumer has the right to withdraw from a distance contract within 14 days, unless an exception applies. If services start before that period ends at the consumer's express request and with their consent, the client may be required to pay a proportionate amount for the service performed up to the moment of withdrawal.

If the service is fully performed with the consumer's express prior consent, after being informed that the right of withdrawal will be lost once the service is completed, the right of withdrawal may not apply.

9. Safety and Client Responsibility

• the client should inform the trainer about medical contraindications, injuries, and mobility limitations that may affect training safety,
• training services do not constitute medical or rehabilitation advice,
• the service provider is not responsible for the consequences of false or incomplete information relevant to training safety,
• the client should use the services and equipment in line with the trainer's instructions and any rules of the venue where the session takes place.

11. Intellectual Property

Content published on the FitNexus website, including text, graphics, page layout, and visual identity elements, is protected by copyright and may not be copied or used without the service provider's consent unless mandatory law states otherwise.

12. Final Provisions

• these Terms and Conditions may be updated for important reasons, such as changes in law, tools, or the scope of services,
• contracts concluded with consumers are governed by Polish and EU law,
• matters not covered by these Terms and Conditions are governed by the applicable law, especially the GDPR, the Polish Consumer Rights Act, and the Act on Provision of Services by Electronic Means.
